Avaya ENGAGE® Loyalty2gether Promotion Contest Rules
Summary: Customer Eligibility:
- Contest is open only to organizations who are present at Avaya ENGAGE and who have received an Eligible Quote (defined below) (“Eligible Customers”). Eligible Customers who submit a pitch entry meeting the specifications outlined here are “Entrants”.
- Eligible Quotes bear a date on or after January 1, 2019, up to and including January 23, 2019, and are to existing Avaya customers with a system that is upgradeable through the Loyalty2gether program (i.e., CS1000 or Communication Manager 6 and below systems. For details on the Loyalty2gether program for CS1000 see here, for details on the Loyalty2gether program for CM6 and below see here). Quotes with dates outside these dates, or quotes to new logo accounts, quotes for deals closed before January 1, 2019 are not eligible for this Contest. Eligible Quotes also include an assessment completed at Avaya ENGAGE for a Loyalty2gether Upgrade.
- Entry must include Eligible Customer’s quote number, or an assessment completed at Avaya ENGAGE.
- Entrant must attend Avaya ENGAGE.
- This is a pitch writing contest. Entrant must write a one sentence pitch of 40 words or less answering the question: Why does your communications experience matter to your organization?
- One entry per Eligible Customer.
- Available to Eligible Customers in the US and Canada (exclude Quebec).
- All entries must be submitted and collected at Avaya ENGAGE via an Entry form including: Quote number or assessment completed at Avaya ENGAGE, Customer name, Contact information – phone & email, Partner name if applicable, Contest Pitch.
Entries Close: One hour prior to Passport to Prizes (Currently scheduled for Wednesday, January 23 at 2:00 p.m., Austin TX local time. Passport to Prizes currently scheduled to start at 3:00 p.m. Time of Passport to Prizes may be changed in Avaya’s discretion without notice.)
Avaya Use of Entries: Entrants agree on behalf of themselves and their Eligible Customer that pitch submissions are the property of Avaya. Avaya will endeavor to keep the pitches anonymous (i.e., company and contact name are not identified in the pitch) except for the Grand Prize winner’s company and contact. Avaya reserves the right to use in marketing and sales materials the Grand Prize winner’s company name and contact along with the Pitch.
Selection Process: Pitch Judging – 50% on Originality and 50% on Persuasiveness.
Award Announcement: Announced by an Avaya executive on the last day of Avaya ENGAGE, Wednesday January 23. This will be during the Passport to Prizes session.
Winners will claim their prizes via notifying their sales team. Avaya will provide the prize via a special discount applied to the order matching the eligible Quote.
The Contest is void where prohibited by law. Entries must be submitted by employees or representatives of the Eligible Customer duly authorized by the Eligible Customer to participate in this Contest and must submit their Pitch in accordance with these rules. The Contest is subject to all applicable federal, state, and local laws and regulations.
Agreement to Rules: By submitting an Entry, Entrants agree to be fully unconditionally bound by these Rules and represent and warrants that they meet the eligibility requirements. In addition, Entrants agree to accept the decisions of Avaya as final and binding as it relates to the content of this Contest.
Contest Period: Entries will be accepted at Avaya ENGAGE in the Loyalty2gether Experience Zone starting on January 20, 12:01 p.m. CST and all entries must be received by 2:00 p.m. CST on January 23. Judging will take place before the winner is announced on January 23, 2019.
How to Enter: The Contest must be entered as follows:
You must write a pitch explaining why your communications experience matters to your organization (“pitch entry”);
The pitch entry must be no more than forty words in length;
The pitch entry must fulfill all Contest requirements and these rules, as specified, to be eligible to win a prize;
A pitch entry that is incomplete or does not adhere to the rules or specifications may be disqualified at the sole discretion of Avaya;
Only one pitch entry per Eligible Customer;
Winner Selection and Notification: Winners will be determined through evaluation of the judges based on originality and persuasiveness. Winners will be required to produce releases for any private property, brand or person featured in the winning submission to receive the prize.
Grand / First Prize: A FREE Loyalty2gether upgrade based on the Loyalty2gether customer proposal / quote. Avaya will provide a free upgrade up to $100,000 list price, or discount by this amount if the proposal / quote is greater than $100,000. Discount will be applied as a credit and must be used on or before June 30, 2019.
Second Prize: A $10,000 discount off the list price of a Loyalty2gether upgrade based on the Loyalty2gether customer proposal / quote. Discount will be applied as a credit and must be used on or before June 30, 2019.
Third Prize: (10) Avaya Vantage K175 Devices & (10) Avaya J179 IP Phones FREE with a Loyalty2gether upgrade based on the Loyalty2gether customer proposal / quote. Offer must be used on or before June 30, 2019.
Winners will be notified by announcement at Engage. Representative of Entrant must be present to win. The winning Entrants will receive confirmation by email within five days following selections of the winners. Avaya shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings of Winner or for Winner’s provision of incorrect or otherwise non-functional contact information. Any and all expenses related to winning will be the sole responsibility of Winner, including without limitation any and all federal, state, and/or local taxes. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. If Winner cannot be contacted, is ineligible, fails to claim the prize within 10 days from the time award notification was sent, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (IN AVAYA’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Rights Associated with Contest: By submitting a pitch entry, Entrants understand and agree that Avaya, anyone acting on behalf of Avaya and Avaya’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your pitch entry, for news, publicity, information, trade, advertising, marketing, public relations, and promotional purposes without any further compensation, notice, review, or consent to Entrants, whether or not they are a Winner. By entering this contest, Entrants represent and warrant that their entry is an original work of authorship and does not violate any third party’s proprietary or intellectual property rights. If an Entrant’s pitch entry infringes upon the intellectual property right of another, Entrant will be disqualified at the sole discretion of Avaya and shall indemnify, defend, and hold harmless Avaya from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Avaya may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
Terms & Conditions: Avaya reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should fraud or other cause beyond Avaya’s corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Avaya may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Avaya. Avaya reserves the right, in its sole discretion, to disqualify any individual who violates these Terms & Conditions.
Limitation of Liability: By entering, Entrants agree to release and hold harmless Avaya and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Entrants’ participation, or the participation of third parties at their request, in the Contest and/or Your possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) electronic or human error in the administration of the Contest or the processing of pitch entries.
Disputes: THIS Contest IS GOVERNED BY THE LAWS OF THE UNITED STATES AND TEXAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, Entrants agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Texas, having jurisdiction. Further, in any such dispute, under no circumstances shall Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Entrants’ actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Entrants further waive all rights to have damages multiplied or increased.
Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Avaya Marketing, 4655 Great America Parkway, Santa Clara, CA 95054 USA. Requests must be received no later than February 15, 2019.
